NY Times: F.B.I. Agents Became C.I.A. Operatives in Secret Overseas Prisons

GUANTÁNAMO BAY, Cuba — In the torturous history of the U.S. government’s black sites, the F.B.I. has long been portrayed as acting with a strong moral compass. Its agents, disgusted with the violence they saw at a secret C.I.A. prison in Thailand, walked out, enabling the bureau to later deploy “clean teams” untainted by torture to interrogate the five men accused of conspiring in the attacks of Sept. 11, 2001.

But new information that emerged this week in the Sept. 11 case undermines that F.B.I. narrative. The two intelligence agencies secretly arranged for nine F.B.I. agents to temporarily become C.I.A. operatives in the overseas prison network where the spy agency used torture to interrogate its prisoners.

The once-secret program came to light in pretrial proceedings in the death penalty case. The proceedings are currently examining whether the accused mastermind of the Sept. 11 plot, Khalid Shaikh Mohammed, and his four co-defendants voluntarily confessed after years in the black site network, where detainees were waterboarded, beaten, deprived of sleep and isolated to train them to comply with their captors’ wishes.

At issue is whether the military judge will exclude from the eventual trial the testimony of F.B.I. agents who questioned the defendants in 2007 at Guantánamo and also forbid the use of reports that the agents wrote about each man’s account of his role in the hijacking conspiracy.

A veteran Guantánamo prosecutor, Jeffrey D. Groharing, has called the F.B.I. interrogations “the most critical evidence in this case.” Defense lawyers argue that the interrogations were tainted by the years of torture by U.S. government agents.

In open court on Thursday, another prosecutor, Clayton G. Trivett Jr., confirmed the unusual arrangement, in which nine F.B.I. agents were “formally detailed” to the agency “and thus became a member of the C.I.A. and worked within C.I.A. channels.”

He said that the agents served as “debriefers,” a C.I.A. term for interrogators, and questioned black site prisoners “out of the coercive environment” and after the use of “E.I.T.s.”

E.I.T.s, or enhanced interrogation techniques, is a C.I.A. euphemism for a series of abusive tactics that the agency used against Mr. Mohammed and other prisoners in 2002 and 2003 — tactics that were then approved but are now illegal. They include waterboarding, painful shackling and isolating a prisoner nude, shivering and in the dark to break his will to resist interrogation.

Mr. Trivett offered no precise time period but made clear that the F.B.I. agents were absorbed by the C.I.A. sometime between 2002, when the black sites were established, and September 2006. On their return to the F.B.I., they took on the status of C.I.A. assets, he said, and so their identities are classified.

Can It Possibly Happen?

“Even as Congress moves to increase the Pentagon budget well beyond the astronomical levels proposed by the Biden administration, a new report from the Congressional Budget Office (CBO) has outlined three different ways to cut $1 trillion in Department of Defense spending over the next decade.  A rational defense policy could yield far more in the way of reductions, but resistance from the Pentagon, weapons contractors, and their many allies in Congress would be fierce.

After all, in its consideration of the bill that authorizes such budget levels for next year, the Democratic-controlled House of Representatives recently voted to add $25 billion to the already staggering $750 billion the Biden administration requested for the Pentagon and related work on nuclear weapons at the Department of Energy. By any measure, that’s an astonishing figure, given that the request itself was already far higher than spending at the peaks of the Korean and Vietnam Wars or President Ronald Reagan’s military buildup of the 1980s.

In any reasonable world, such a military budget should be considered both unaffordable and deeply unsuitable when it comes to addressing the true threats to this country’s “defense,” including cyberattacks, pandemics, and the devastation already being wrought by climate change. Worst of all, providing a blank check to the military-industrial-congressional complex ensures the continued production of troubled weapon systems like Lockheed Martin’s exorbitantly expensive F-35 Joint Strike Fighter, which is typically behind schedule, far above projected costs, and still not considered effective in combat.

Changing course would mean real reform and genuine accountability, starting with serious cuts to a budget for which “bloated” is far too kind an adjective.

Three Options for Reductions

At the request of Senate Budget Committee Chair Bernie Sanders (I-VT), the CBO devised three different approaches to cutting approximately $1 trillion (a decrease of a mere 14%) from the Pentagon budget over the next decade.  Historically, it could hardly be a more modest proposal. After all, without any such plan, the Pentagon budget actually did decrease by 30% between 1988 and 1997.

Such a CBO-style reduction would still leave the department with about $6.3 trillion to spend over that 10-year period, 80% more than the cost of President Biden’s original $3.5 trillion Build Back Better proposal for domestic investments. Of course, that figure, unlike the Pentagon budget, has already been dramatically whittled down to half its original size, thanks to laughable claims by “moderate” Democrats like Senator Joe Manchin (D-WV) that it would break the bank in Washington.  Yet such critics of expanded social and economic programs rarely offer similar thoughts when it comes to the Pentagon’s far larger bite of the budgetary pie.

The options in the budget watchdog’s new report are anything but radical:

Option one would preserve the “current post-Cold War strategy of deterring aggression through [the] threat of immediate U.S. military response with the objectives of denying an adversary’s gains and recapturing lost territory.” The proposed cuts would hit each military service equally, with some new weapons programs slowed down and a few, as in the case of the B-21 bomber, cancelled.

Option two “adopts a Cold War-like strategy for large nuclear powers of making aggression very costly and recognizing that the size of conventional conflict would be limited by the threat of a nuclear response.” That leaves nearly $2 trillion for the Pentagon’s planned “modernization” of the U.S. nuclear arsenal untouched, while relying more heavily on working with allies in conventional war situations than current strategy allows for.  It would mean that the military might take longer to deploy in large numbers to a conflict.

Option three “de-emphasizes use of U.S. military force in regional conflicts in favor of preserving U.S. control of the global commons (sea, air, space, and the Arctic), ensuring open access to the commons for allies and unimpeded global commerce.” In other words, Afghan- or Iraq-style boots-on-the-ground U.S. interventions would largely be avoided in favor of the use of long-range and “over-the-horizon” weapons like drones, naval blockades, the enforcement of no-fly zones, and the further arming and training of allies.

But looking more broadly at the question of what will make the world a safer place in an era of pandemics, climate change, racial injustice, and economic inequality, reductions well beyond the $1 trillion figure embedded in the CBO’s recommendations would be both necessary and possible in a more reasonable American world.  The CBO’s scenarios remain focused on military methods for solving security problems, assuring an all-too-narrow view of what might be saved by a new approach to security.

Nuclear Excess

The CBO, for instance, chose not to look at possible savings from simply scaling back (not even ending) the Pentagon’s $2-trillion, three-decades-long plan to build a new generation of nuclear-armed missiles, bombers, and submarines, complete with accompanying new warheads. Scaling back such a buildup, which will only further imperil this planet, could easily save in excess of $100 billion over the next decade.

One significant step toward nuclear sanity would be to adopt the alternative nuclear posture proposed by the organization Global Zero. That would involve the elimination of all land-based nuclear missiles and rely instead on a smaller force of ballistic missile submarines and bombers as part of a “deterrence-only” strategy.

Land-based, intercontinental ballistic missiles were accurately described by former Secretary of Defense William Perry as “some of the most dangerous weapons in the world.” The reason: a president would have only a matter of minutes to decide whether to launch them upon being warned of an oncoming nuclear attack by an enemy power. That would, of course, greatly increase the risk of an accidental nuclear war and the potential destruction of the planet prompted by a false alarm (of which there have been several in the past).  Eliminating such missiles would make the world a far safer place, while saving tens of billions of dollars in the process.

Capping Contractors

While most people think about the Pentagon budget in terms of what it spends on new guns, ships, planes, and missiles, services are about half of what it buys every year. These are the contracts that go to various corporate “Beltway bandits” to consult with the military or perform jobs that could often be done more cheaply by federal employees. Both the Defense Business Board and the Pentagon’s own cost estimating office have identified service contracting as an area where there are significant opportunities for large-scale savings.

Last year, the Pentagon spent nearly $204 billion on various service contracts. That’s more than the budgets for the Departments of Health and Human ServicesState, or Homeland Security. Reducing spending on contractors by even 15% would instantly save tens of billions of dollars annually.

In the past, Congress and the Pentagon have shown that just such savings could easily be realized. For example, a provision in a 2011 defense law simply capped such spending at 2010 levels. Government spending data shows that, in the end, it was reduced by $42 billion over four years.

Closing Unneeded Bases

While the Biden administration seeks to expand domestic infrastructure spending, the Pentagon has been desperate to shed costly and unnecessary military facilities. Both the Obama and Trump administrations asked Congress to authorize another round of what’s called base realignment and closure to help the Defense Department get rid of its excess capacity. The Pentagon estimates that it could save $2 billion annually that way.

The CBO report cited above explicitly excludes any consideration of such cost savings as politically unfeasible, given the present Congress. But considering the ways in which climate change is going to threaten current military basing arrangements domestically and globally, that would be an obvious way to go.

Another CBO report warns that the future effects of climate change — from rising sea levels (and flooding coastlines) to ever more powerful storms — will both reduce the government’s revenue and increase its mandatory spending, if its base situation remains as it is now. After all, ever fiercer tropical storms and hurricanes, as well as rising levels of flooding, are already resulting in billions of dollars in damage to military bases. Meanwhile, it’s estimated that, in the decades to come, more than 1,700 U.S. military installations worldwide may be impacted by sea-level rise. Future rounds of base closings, both domestic and global, should be planned now with the impact of climate change in mind.

Turning Around Congress, Fighting Off Lobbyists

So far, boosting Pentagon spending has been one of the only things a bipartisan majority of this Congress can agree on, as indicated by that House decision to add $25 billion to the Pentagon budget request for Fiscal Year 2022.  A similar measure is included in the Senate version, which it will debate soon. There are, however, glimmers of hope on the horizon as the number of members of Congress willing to oppose the longstanding practice of shoveling ever more funds at the Pentagon, no questions asked, is indeed growing.

For example, a majority of Democrats and members of the leadership in the House of Representatives supported an ultimately unsuccessful provision to strip some excess funds from the Pentagon this year. A smaller group voted to cut the department’s budget across the board by 10%. Still, it was a number that would have been unthinkable just a few years ago. That core group is only likely to grow in the years to come as the costs of non-military challenges like pandemics, climate change, and the financial impact of racial and economic injustice supplant traditional military risks as the most urgent threats to American lives and livelihoods.

Opposition to increased Pentagon spending is growing outside of Washington as well. An ever wider range of not just progressive but conservative organizations now support substantial reductions in the Pentagon budget. The challenge, however, is to translate such sentiments into a concerted, multifaceted campaign of public pressure that will move a majority of the members of Congress to stop giving the Pentagon a yearly blank check. A new poll from the Eurasia Group Foundation found that twice as many Americans now support cutting the Pentagon budget as support increasing it.

Any attempt to curb Pentagon spending will run up against a strikingly powerful arms industry that deploys campaign contributions, lobbyists, and promises of defense-related employment to keep budgets high. In this century alone, the Pentagon has spent more than $14 trillion, up to one half of which has gone to contractors. During those same years, the arms industry has spent $285 million on campaign contributions and $2.5 billion on lobbying, most of it focused on members of the armed services and defense appropriations committees that take the lead in deciding how much the country spends for military purposes.

The arms industry’s lobbying efforts are especially insidious. In an average year, it employs around 700 lobbyists, more than one for every member of Congress. The top five corporate weapons makers got a return of $1,909 in taxpayer funds for every dollar they spent on lobbying.  Most of their lobbyists once worked in the Pentagon or Congress and arrived in the world of arms contractors via the infamous “revolving door.”  Of course, they then used their relationships with their former colleagues in government to curry favor for their corporate employers.  A 2018 investigation by the Project On Government Oversight found that, in the prior decade, 380 high-ranking Pentagon officials and military officers had become lobbyists, board members, executives, or consultants for weapons contractors within two years of leaving their government jobs.

A September 2021 study by the Government Accountability Office found that, as of 2019, the top 14 arms contractors employed more than 1,700 former military or Pentagon civilian employees, including many who had previously been involved in making or enforcing the rules for buying major weapons systems.

The revolving door spins both ways, with executives and board members of the major weapons makers moving into powerful senior positions in government where they’re well situated to help their former (and, more than likely, future) employers. The process starts at the top.  Four of the past five secretaries of defense have also been executives, lobbyists, or board members of Raytheon, Boeing, or General Dynamics, three of the top five weapons makers that split tens of billions of dollars in Pentagon contracts annually. Both the House and Senate versions of the 2022 National Defense Authorization Act extend the periods of time in which those entering the government from such industries have to recuse themselves from decisions involving their former companies. Still, as long as the Pentagon continues to pluck officials from the very outfits driving those exploding budgets, we should all know more or less what to expect.

So far, the system is working — if you happen to be an arms contractor. The top five weapons companies alone split $166 billion in Pentagon contracts in Fiscal Year 2020, well over one-third of those issued by the Department of Defense that year.  To give you some sense of the scale of all this — and our government’s twisted priorities — Lockheed Martin alone received $75 billion in Pentagon contracts in Fiscal Year 2020,  nearly one and one-half times the $52.5 billion allocated for the State Department and the Agency for International Development combined.

Which Way Forward?

The Congressional Budget Office’s new report charts a path toward a more rational approach to Pentagon spending, but the $1 trillion in savings it proposes should only be a starting point. Hundreds of billions more could be saved over the next decade by reassessing our national security strategy, cutting back the Pentagon’s nuclear buildup, capping its use of private contractors, and scaling back the colossal sums of waste, fraud, and abuse baked into its budget. All of this could be done while making this country and the world a significantly safer place by shifting such funds to addressing the non-military risks that threaten the future of humanity.

Whether our leaders meet the challenges of today or continue to succumb to the power of the arms lobby is an open question.”

Legal Initiatives

1.       Lawsuit #1 filed, challenging the Environmental Assessment on construction at Truax, asserting that it was not legally prepared. Best case scenario: they would have to stop construction and do a a full Environmental Impact Statement.

2.      Lawsuit #2 filed, challenging Environmental Impact Statement on the F-35 basing decision, arguing that the existing EIS uses old documents and does not include new information, including PFAS evidence and stricter noise standards currently under review. A judge will decide whether the record can be extended, with a decision possible next year.

3.       An Environmental Justice Complaint is being drafted. The Air Force is not subject to EJ policies or laws (although it should be), others are subject to it: Air National Guard, Air National Guard Bureau, Dane County, Dane County Airport, and the Governor as Commander in Chief of the Air National Guard.

Killer Robots: Applying arms-control frameworks to autonomous weapons

“Mankind’s earliest weapons date back 400,000 years—simple wooden spears discovered in Schöningen, Germany. By 48,000 years ago, humans were making bows and arrows, then graduating to swords of bronze and iron. The age of gunpowder brought flintlock muskets, cannons, and Gatling guns. In modern times, humans built Panzer tanks, the F-16 Fighting Falcon, and nuclear weapons capable of vaporizing cities.

Today, humanity is entering a new era of weaponry, one of autonomous weapons and robotics.

The development of such technology is rapidly advancing and poses hard questions about how their use and proliferation should be governed. In early 2020, a drone may have been used to attack humans autonomously for the first time, a milestone underscoring that robots capable of killing may be widely fielded sooner rather than later. Existing arms-control regimes may offer a model for how to govern autonomous weapons, and it is essential that the international community promptly addresses a critical question: Should we be more afraid of killer robots run amok or the insecurity of giving them up?

The current state of autonomy

The first use of an autonomous weapon to kill is thought to have occurred in March of 2020 in Libya, but what actually happened in remains murky. According to a UN report, a Turkish-made Kargu-2 drone is reported to have autonomously “hunted down” members of the Libyan National Army. If the manufacturer’s claims are correct, the Kargu-2 can use machine learning to classify objects, apparently allowing it to “autonomously fire-and-forget.” Turkey denies using the Kargu-2 in this way, though seems to acknowledge the Kargu-2 can be used autonomously. Regardless of whether Kargu-2 was used autonomously in the episode in Libya, the claim that Kargu-2 can be autonomous is plausible on its face.

The United Nations report about the Kargu-2 caused an uproar. Sensationalist headlines compared the Kargu-2 to a “Terminator-style AI drone” that “hunted down human targets without being given orders.” These stories conjured images of out of control, sentient robots killing as they saw fit. To be blunt, that is nonsense. Although artificial intelligence—technically a super intelligent narrow AI—can beat the world’s best human chess and Go players, that is far from a generalized, human-level intelligence like the Terminator. In fact, a sticky note is enough to convince a cutting edge machine vision system that an apple is an iPod.

But simple autonomy is not that hard, and autonomous weapons have been a feature of warfare for centuries. Autonomy is about machines operating without human control. The weapon just needs a sensor, a way to process sensor information, and activate the harmful payload. During the American Civil War, Confederate forces deployed the “Rains Patent,” a simple landmine made of sheet iron with a brass cap sealed in beeswax to protect the fuse. When Union soldiers put sufficient pressure on the Rains Patent, it exploded.

Modern autonomous weapons play a real, but relatively limited role in military operations. The Ottawa Convention banned anti-personnel mines, but anti-vehicle and sea mines are still used. Loitering munitions are somewhere between a drone and a missile, hovering above a battlefield and striking targets that meet various designations. The U.S. Phalanx close-in weapon system, the Israeli Iron Dome, and various active defense systems defend against incoming missiles and other close range risks with varying degrees of autonomy. Along the demilitarized zone between South and North Korea, South Korea has deployed the SGR A-1 gun turret, which reportedly has an optional fully autonomous mode. This is just the beginning.

Though hype in the view of some, artificial intelligence has won over the world’s great military powers as the next great military technology. The U.S. National Security Commission on AI recently concluded that “properly designed, tested, and utilized AI-enabled and autonomous weapon systems will bring substantial military and even humanitarian benefit.” The Chinese People’s Liberation Army believes AI could fundamentally change the character of warfare. Russian President Vladimir Putin’s claim—that the world’s AI leader “will become the ruler of the world”— has become cliché.

Such excitement has translated to new research, prototypes, and increasingly operational autonomous weapons with increasing degrees of sophistication. The Defense Advanced Research Projects Agency—the U.S. military’s high risk, high-reward research and development center that helped birth the internet and GPS—ran a virtual dogfight between an F-16 Fighting Falcon and an artificial intelligence last year. The AI beat the human in each of five rounds. China is doing the same, with similar results. The United StatesChina, and Russia are all developing loyal wingman drones: unmanned semi-autonomous or autonomous aircraft that support manned aircraft. The pilot provides strategic decisions, while the artificial intelligence manages the details.

Growing autonomy is closely tied to the rise of unmanned platforms. Numerous states are testing, building, and deploying a wide range of unmanned aircraft, shipssubmarines, and tanks. Unmanned platforms require remote orders to achieve their mission. That’s tough when militaries cannot provide the full staff needed and pilots burn out from overwork. Plus, enemies seek to jam, manipulate, or otherwise interfere with the signals from the pilots to the drone. The more that unmanned platforms can operate without human control, the less need for those signals and the people sending them.

States are integrating unmanned platforms into drone swarms, and in May, Israel became the world’s first to deploy a swarm in combat. In a true drone swarm, the drones communicate and collaborate, forming a single weapons platform. While drone swarms are not necessarily autonomous weapons, no human could control 10,000 drones without artificial intelligence helping. Israel’s groundbreaking use of a drone swarm appears to have consisted of an unknown number of small drones equipped with a mixture of sensors and weapons. Israel’s swarm use is just the beginning. India tested a 75-drone swarm last year, and earlier this year, South Africa’s Paramount Group revealed a swarming system of 41-kilogram long-range drones that cruise at more than 100 miles per hour. Russia, meanwhile, is designing swarms for anti-submarine warfare. Numerous other states are developing other swarm applications.

Assuming these trends continue, autonomous weapons will increasingly enter the battlefield. For some, that’s terrifying.

In his Christmas address of 1937, the Archbishop of Canterbury posed a prescient question: “Who can think without horror of what another widespread war would mean, waged as it would be with all the new weapons of mass destruction?” Arms control debates are rooted in fear, and treaties to control the spread of weapons have sought to address them. Advocates of arms-control treaties fear the consequences of horrific weapons of war spreading widely. Opponents fear what might happen if their adversaries build such weapons, but they cannot. These dueling fears animate everything from gun debates around the dinner table to nuclear arms debates at the United Nations. The proliferation of autonomous weapons creates new fears: that autonomous weapons might misidentify a civilian as a soldier and killing him, that autonomous weapons will provide an enemy state a decisive edge in war.

In an autonomous weapon, the system decides when to engage by processing environmental stimuli. Landmines, for example, use simple pressure sensors—the sensor sensitivity determines whether the heft of a tank or the hands of a child are enough to trigger the explosion. Conversely, an anti-radar loitering munition homes in on radar signals. The risk of error—and by extension the arms control concern—depend on the type of environmental stimuli, how the stimuli is processed, and the type of decisions made.

Emerging autonomous weapons using machine learning process stimuli in more complex ways. Machine learning systems rely on large amounts of data to draw conclusions about what the system observes. But the data dependence also makes them brittle. Color differences, tree branches, or foggy days may confound the ability of the system to correctly identify a target. Although some states may adopt robust verification and testing programs to increase reliability, others may not. As autonomous weapons are deployed in larger numbers, arms control advocates fear a higher likelihood of something going horrifyingly wrong.

As autonomous weapons scale into massive drone swarms, the uncontrolability and potential for mass harm create a new weapon of mass destruction. Imagine 1,000 Slaughterbots flitting about a city, deciding who to kill. And that’s not terribly outlandish: India wants to build a swarm of 1,000 drones operating without human control. And the Naval Postgraduate School is modeling swarms of up to a million drones, operating underwater, on the ocean’s surface, and in the air. Particularly nefarious governments might equip the drones with facial recognition to assassinate regime opponents or carry out ethnic cleansing. States have adopted a wide range of policies to reduce similar risks from traditional weapons of mass destruction, including export controls, arms control treaties, and deterrent and coercive threats. If drone swarms are weapons of mass destruction, they deserve similar risk reduction policies.

At the same time, militaries see great value in the development of autonomous weapons. Autonomous weapons offer speed. A typical human takes 250 milliseconds to react to something they see. An autonomous weapon can respond far faster—Rheinmetall Defense’s Active Defense System can react to incoming rocket-propelled grenade in less than one millisecond. According to General George Murray, head of the U.S. Army’s Future Command, that speed may be necessary to defend against massive drone swarms. These weapons may be the difference between survival and defeat. Giving them up in an arms control treaty would be foolish.

Militaries also dispute the risk of error. Humans get tired, frustrated, and over-confident. That creates mistakes. Autonomous weapons have no such emotion, and advocates of military AI applications argue a reduced error-rate makes pursuing the technology a moral imperative. Plus, artificial intelligence can improve aiming. That reduces collateral harm. For example, Israel reportedly used an artificial intelligence-assisted machine gun to assassinate an Iranian nuclear scientist without hitting the scientist’s wife inches away. So, in their view, what are arms control advocates really afraid of?

Work on this issue is ongoing. Diplomats have debated autonomous weapons issues under the United Nations Convention on Conventional Weapons Group of Governmental Experts on Lethal Autonomous Weapons since 2014. These meetings have accomplished little to create an international treaty on autonomous weapons, but they have helped clarify state positions, brought greater attention to the topic, and better articulated concerns regarding autonomous weapons. Arms control advocates have called for bans and new treaties, but these vary in scope. Groups like the Campaign to Stop Killer Robots argue all autonomous weapons must be banned. Others, like the International Committee of the Red Cross, have a more nuanced view, focusing on “unpredictable” weapons. Human Rights Watch estimates 30 states have endorsed a complete ban.Great military powers have resisted a new arms-control regime, arguing existing international law is sufficient to cover autonomous weapons. Researchers have also floated alternatives to arms control treaties, such as norms and bilateral and multi-lateral confidence-building measures.

The global community must now resolve the tension of fear between arms-control and military advocates. That means serious debate on which types of autonomous weapon offer the most military value and which present the most risk to civilians and noncombatants. Weapons with high risk to civilians and low military value should form the basis of conversations around risk reduction.

Existing arms control treaties offer models to address these complexities. The Ottawa Convention on Anti-Personnel Landmines narrowly focuses on anti-personnel landmines, excluding anti-vehicle landmines that require high pressure to detonate. An autonomous weapon treaty might focus on anti-personnel weapons using machine learning, given the challenges of distinguishing farmers from soldiers. A more precise treaty may allow military powers to separate weapons they fear giving up from the weapons arms control advocates fear proliferating. This may make getting an okay from those powers easier.

Autonomous weapons might also be tiered based on characteristics that make them more or less risky, akin to the Chemical Weapons Convention’s schedules. The convention divides chemical agents into three schedules, based on their historical use as chemical weapons and use for civilian purposes. Chemicals in each schedule have different restrictions placed upon them. Autonomous weapons could also be tiered based on the risk the weapons pose, particularly the risk to civilian populations if the weapon errs and the likelihood of an error. Defensive turrets used at sea to defend against incoming missiles would likely be of lowest risk, while offensive weapons targeting people using machine learning would be a higher tier. Autonomous chemical, biological, radiological, and nuclear weapons are the highest risk, and should never be used.

Debate is needed on the best policy approaches to stem the proliferation of the highest risk weapons, and reduce broader global risks. Existing global discussion has focused on whether international treaties should ban the weapons, but that’s just a start. Even if autonomous weapons are banned in whole, in part, or not at all, governments must consider how to ensure they are not inadvertently exported to states not party to the ban. Restricting access to terrorist groups is an extra, different problem as autonomous weapons are simple enough to be made as a classroom project. And if a new international treaty is established, an obvious question is: How can it be given teeth? If a state uses a banned autonomous weapon, should they suffer retaliatory diplomatic or economic sanctions? When, if ever, should the United Nations Security Council endorse military action?
